1. Overview
Welcome to Curiosity District (“Curiosity District,” “we,” “us,” or “our”). We operate this website and online store, including all related content, features, tools, products, and services (collectively, the “Services”). Our store is powered by Shopify, which helps us provide the Services to you.
These Terms of Service (“Terms”), together with any policies referenced here (including our Privacy Policy and Refund/Return Policy, describe your rights and responsibilities when you use the Services.
By accessing, browsing, or using the Services, or by placing an order, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
2. Eligibility; Accounts
You must be at least 18 years old (or the age of majority where you live) to use the Services. If you allow a minor to use the Services on a device you own or manage, you are responsible for that minor’s activity.

Please review your order carefully before submitting it. After acceptance, we may be unable to cancel or change your order. If we cancel or change an order, we will attempt to notify you using the contact information you provided.
Returns and exchanges are governed solely by our Refund/Return Policy.
You represent that you are purchasing for personal or household use, not for resale or export.
5. Prices; Taxes; Billing
Prices, discounts, and promotions may change without notice. The price charged is the price shown at checkout at the time you place your order. Unless stated otherwise, prices do not include shipping, handling, duties, or taxes.
You agree to provide current, complete, and accurate payment and account information and to promptly update it as needed.
By submitting payment information, you represent that you are authorized to use the payment method and that you authorize us (and our payment processors) to charge the total amount of your order, including applicable taxes and shipping.
6. Shipping; Delivery; Risk of Loss
Delivery dates are estimates only and not guaranteed. We are not responsible for delays caused by carriers, customs, or events outside our control.
Risk of loss and title for items pass to you upon our delivery of the products to the carrier (to the extent permitted by applicable law).
7. Intellectual Property
The Services and all content on the Services—including trademarks, logos, product names, text, images, graphics, video, audio, and the selection and arrangement of the foregoing—are owned by Curiosity District, our licensors, or other providers and are protected by U.S. and international intellectual property laws.
You may use the Services only for your personal, non-commercial use. You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any content from the Services without our prior written consent, except as permitted by law.
Curiosity District’s name, logo, and related marks are our trademarks. Shopify’s name and marks are Shopify’s trademarks. All other trademarks belong to their respective owners.
8. Optional Tools; Third-Party Services
The Services may include tools or features provided by third parties. We provide access to such tools “as is” and “as available” and do not control or endorse them.
If you use third-party tools or services, you do so at your own risk and are responsible for reviewing and complying with any third-party terms.

The Services may contain links or embedded functionality from third parties. We are not responsible for third-party sites or content. If you leave our Services, you do so at your own risk. Any purchases from third parties are between you and the third party.
10. Relationship with Shopify
Curiosity District is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Curiosity District. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Curiosity District, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Curiosity District.

Our collection and use of personal information is described in our Privacy Policy. Because our store is hosted on Shopify, Shopify may process certain data to provide and improve the Services. Please review our Privacy Policy for details.
12. Feedback; User Content
If you submit reviews, comments, suggestions, or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display that Feedback for any lawful purpose, including operating and improving the Services.
You represent that you own or have the rights necessary to submit Feedback and that your Feedback will not violate law or the rights of any third party. We may remove Feedback at our discretion.

We may correct any errors and update information at any time, including after an order is submitted, and may cancel orders if information is inaccurate.

Sections that by their nature should survive will survive termination, including Intellectual Property, Feedback, Disclaimers, Limitation of Liability, Indemnification, and Governing Law/Disputes.

17. Limitation of Liability
To the fullest extent permitted by law, Curiosity District (and our owners, employees, affiliates, agents, contractors, service providers, and licensors, and Shopify and its affiliates) will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Services or any products.
To the fullest extent permitted by law, our total liability for any claim arising out of or related to the Services or any product will not exceed the amount you paid to us for the product(s) giving rise to the claim.
Some states do not allow certain limitations of liability, so some of the above may not apply to you.
18. Indemnification
You agree to indemnify, defend, and hold harmless Curiosity District, Shopify, and our affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Services, (b) your violation of these Terms, or (c) your violation of any law or the rights of a third party.
19. Severability
If any provision of these Terms is found unlawful or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
20. Waiver; Entire Agreement
Failure to enforce any provision is not a waiver. These Terms and the policies referenced herein are the entire agreement between you and Curiosity District regarding the Services and supersede prior agreements or communications.
21. Assignment
You may not assign these Terms without our prior written consent. We may assign these Terms at any time.
22. Governing Law; Venue
These Terms are governed by the laws of Washington DC, without regard to conflict-of-laws rules.
Unless you and Curiosity District agree otherwise, any dispute that is not subject to arbitration (if you adopt the optional arbitration section below) must be brought in the state or federal courts located in the United States in Washington DC, and you consent to personal jurisdiction and venue there.
